Podcast Disclaimer

1. Scope and Publisher

Frayed and any other podcast, audio program, video program, article, transcript, social-media content, or related publication identified as a November 8 Studios production are produced or published by November 8 Studios, LLC (collectively, “November 8 Studios,” “we,” “us,” or “our”). This Disclaimer applies to all such content unless a more specific written notice states otherwise.

2. Educational, Informational, and Commentary Purposes

Our content is created for educational, informational, journalistic, documentary, and commentary purposes. It may examine crimes, court proceedings, public controversies, mental health, trauma, abuse, social-service systems, law-enforcement responses, institutional failures, warning signs, and related subjects. The content is intended to encourage informed discussion and public awareness. It is not presented as a complete record of every fact, allegation, proceeding, or viewpoint.

3. Sources and Lawful Use

November 8 Studios relies on sources that we reasonably believe were lawfully obtained or lawfully accessed, including publicly available court records, government records, law-enforcement releases, trial and appellate materials, books, news reports, documentaries, interviews, public statements, archival materials, academic or professional publications, and other published sources. We may summarize, paraphrase, quote, critique, or comment on source material through original reporting and commentary, attribution, permission, licensing, or other uses permitted by applicable law. Public availability does not necessarily place material in the public domain, guarantee its accuracy, or eliminate third-party rights.

4. Accuracy, Disputed Information, and Developing Matters

We make reasonable efforts to distinguish verified facts, allegations, witness accounts, legal arguments, opinions, and our own analysis. Nevertheless, sources may be incomplete, inconsistent, disputed, sealed, corrected, later discredited, or affected by new evidence, appeals, post-conviction proceedings, or changing law. Unless expressly stated otherwise, references to allegations are allegations, and references to a person charged with a crime should not be understood as a statement of guilt before a final adjudication. We do not guarantee that every statement is error-free, exhaustive, or current after its original publication date.

5. No Diagnosis or Clinical Assessment

November 8 Studios does not diagnose, evaluate, examine, treat, or provide a clinical assessment of any person discussed in its content. Descriptions of behavior, symptoms, trauma, mental illness, substance use, personality traits, developmental history, risk factors, warning signs, or possible motivations are based on the identified record and are presented for discussion and commentary. They must not be interpreted as a medical, psychiatric, psychological, neurological, forensic, or other professional diagnosis or opinion unless a qualified professional is specifically identified and the limits of that professional’s statement are explained.

6. No Professional Advice

Nothing published by November 8 Studios constitutes medical, mental-health, psychiatric, psychological, legal, law-enforcement, investigative, forensic, financial, safety, crisis-intervention, social-work, or other professional advice. Content is not a substitute for advice from a qualified professional familiar with the listener’s individual circumstances. Listeners should not delay seeking professional help, disregard professional advice, or take or avoid action solely because of something heard, read, or viewed in our content.

7. No Excuse, Justification, or Minimization of Crime

Discussing a person’s mental health, trauma, upbringing, relationships, social environment, substance use, institutional contact, or other contributing circumstances is not intended to excuse, justify, defend, normalize, minimize, or shift responsibility for criminal conduct, abuse, neglect, or harm. Explanation is not exoneration. Responsibility for unlawful conduct is determined by the applicable facts and law, and primary attention remains on victims, survivors, affected families, and the consequences of the conduct.

8. Respect for Victims, Survivors, and Families

Our purpose is not to sensationalize suffering or exploit victims. We aim to discuss victims, survivors, families, and affected communities with care and respect. Some subjects may involve graphic violence, child abuse, domestic violence, suicide, self-harm, sexual violence, mental illness, or other disturbing material. Listener discretion is advised. The inclusion or omission of a person’s name or detail does not indicate judgment about that person’s importance, credibility, or experience.

9. Opinions, Guests, and Third Parties

Opinions and interpretations expressed by a host, guest, interviewee, contributor, source, advertiser, or quoted third party are their own unless expressly adopted by November 8 Studios. Guest participation does not imply that November 8 Studios verifies or endorses every guest statement. References or links to third-party organizations, publications, products, services, charities, or resources are provided for context or convenience and do not automatically constitute endorsement, affiliation, sponsorship, or a guarantee of their accuracy, safety, practices, or continued availability.

10. Sponsorships, Advertising, and Affiliate Relationships

When content includes paid advertising, sponsorship, complimentary products or services, affiliate relationships, or another material connection that could affect how a recommendation is understood, November 8 Studios will provide an appropriate disclosure. Advertising or sponsorship does not give a sponsor editorial control unless expressly disclosed.

11. Copyright, Trademarks, and Identification of Persons or Entities

Third-party names, quotations, trademarks, service marks, photographs, audio, video, documents, and other materials remain the property of their respective owners. Their use is for identification, reporting, criticism, commentary, education, licensing, permission, or other lawful purposes. Such use does not imply sponsorship, approval, or affiliation. No listener may reproduce or redistribute November 8 Studios content except as allowed by applicable law or with prior written permission.

12. Emergencies and Reporting

November 8 Studios is not an emergency, crisis, investigative, law-enforcement, child-protection, or victim-services provider and does not monitor communications continuously. Anyone facing an immediate threat should contact 911 or the appropriate local emergency service. Suspected abuse, neglect, exploitation, threats, or criminal activity should be reported to the appropriate authorities or qualified service provider. Resource information may change, and listeners should verify current availability.

13. Corrections and Contact

November 8 Studios welcomes specific, good-faith correction requests concerning a material factual statement. A request should identify the episode or publication, the disputed statement, the basis for the requested correction, and reliable supporting documentation. Submissions may be sent to november8studios@hotmail.com. Receipt of a request does not require removal, correction, response, or agreement, but credible information will be reviewed in good faith.

14. No Waiver and No Guarantee of Legal Protection

This Disclaimer is intended to clarify the nature and limits of our content. It does not create a contract, professional relationship, fiduciary duty, duty of care beyond that imposed by law, or guarantee against claims or liability. Rights and obligations that cannot lawfully be limited remain unaffected.

LEGAL AND EDITORIAL BASIS REVIEWED

This language was drafted with the following principles in mind:

  • U.S. Copyright Office guidance that commentary, criticism, and news reporting may support limited fair use, but that fair use is fact-specific and has no automatic word, percentage, or duration rule.

  • Defamation principles requiring particular care with false factual assertions and reckless disregard for truth; a disclaimer does not cure defamatory reporting.

  • Federal Trade Commission guidance that paid endorsements and material brand relationships should be clearly disclosed, including in podcasts.

  • Federal victim-rights principles recognizing dignity and privacy, used here as an editorial standard rather than as a claim that the federal statute directly governs every podcast publication.
